NDIS Claiming 90-Day Timeframe: Understanding the Impact

As part of recent changes to the NDIS outlined by the Department of Health and Aged Care, the time frame for submitting claims to the NDIS will be reduced from 2 years to 90 days from the date of the support being delivered. This change is coming into place for claims submitted from 1st December 2026. The NDIA have already started checking claims submitted more than 12 months after the support was delivered, providers should aim to submit invoices for processing as soon as possible to avoid any issues.

 

What does the 90-day claiming timeframe mean for participants and providers?

Once this change comes into effect from 1st December 2026, as a plan manager we will not be able to submit an invoice to the NDIA for payment if the support was delivered more than 90 days ago.

For participants, this should have minimal impact if your providers are submitting their invoices in a timely manner. However, you should keep track of your funding to ensure budgets are not being exhausted before the funding period ends. If you’re plan managed by MyIntegra we will help you track this and notify you if your funding is running low.

For providers, we recommend submitting invoices as soon as possible to ensure they do not accumulate and get submitted past the 90-day cut-off. You should also be sure to keep organised records of when services are delivered and if you have outstanding invoices, we recommend submitting these as soon as possible to avoid any issues.

 

The biggest challenge: funding period budgets exhausted

The most significant impact of this change could arise if a participant has a PACE plan with funding periods and the budget for the current funding period is exhausted. Currently, an invoice may be held under certain circumstances and paid when the new funding period is released. However, with most funding periods being 3 months in length, this could result in an invoice being held for longer than 90 days. With the new 90-day timeframe for claiming, a support that has already been provided would not be able to be paid, if more than 90 days have passed since the support was delivered.

 

What participants and/or nominees can do

Participants and/or nominees should keep track of spending and NDIS budgets to ensure there is enough funding to cover supports before they are delivered. If you use a plan manager, like MyIntegra, you will have access to an online portal which makes this a lot simpler.

If your current plan has insufficient funds available to deliver the supports you need, you may request a plan variation from the NDIA. You can ask them to bring funding forward from a future funding period to allow your providers invoice to be processed within the 90-day timeframe. However, this isn’t always guaranteed. You should consider and discuss with the NDIA whether this is a one-off situation or a change in circumstance requiring an ongoing change to your plan. This helps ensure spending remains on track and reduces the risk of continued overspending.

You should not feel pressured by a provider to request a plan variation if it is not necessary or aligned with your NDIS plan and goals. You should only request a plan variation if you genuinely believe a change should be made to your NDIS plan. However if you do not request a plan variation, or the request is rejected by the NDIA, you may be required to pay for the invoice out of pocket.

What providers can do

For confidence that you will be paid for supports you provide to NDIS participants, we encourage providers to regularly check available funding before delivering supports. You should also ensure invoices are submitted as soon as possible after a support has been delivered to avoid payment issues.
If there are not enough funds available for a support you have already delivered, the participant or nominee may have the option of applying to the NDIA for a plan variation, to bring forward funding. The NDIA may bring funds forward from a future funding period, if it meets the participants NDIS goals, however this is not guaranteed. In this situation, we also recommend talking to the participant about ongoing supports and consider if adjustments should be made.

Will participants lose funding if a claim is submitted after 90 days?

No, the new 90-day claiming timeframe does not have an impact on NDIS funding allocation. However, if a claim is submitted after the 90 days, the invoice will be unable to be paid from the participants plan.

Yes, the 90-day claiming timeframe applies to all NDIS payments regardless of how your plan is managed.

What happens if a funding period has been exhausted?

If a funding period has been exhausted, we may be able to process the invoice once sufficient funding is released from a new funding period. However, with the new 90 day claiming timeframe, we cannot process the invoice if the date of service is greater than 90 days from the next funding period release date.

Can a plan variation help release funding sooner?

Yes, if a funding period budget is exhausted a participant or nominee can contact the NDIA to ask for a plan variation to bring funds from the next funding period into the current funding period, however this is not guaranteed and you will need to have a reasonable explanation for the next funding period to be brought forward.
